Terms and Conditions
1. Booking and Cancellation Policy:
- Bookings can only be cancelled before they are accepted by the supplier.
- Once a booking is accepted by the supplier, cancellations are not allowed, and refunds will not be provided.
2. Rider Responsibilities:
- The customer must possess a valid driver's license appropriate for the type of vehicle being rented.
- The customer is required to inspect the vehicle before accepting it and provide the 2-digit handover code to the supplier (if complete payment by card) or pay the remaining balance in cash (if only deposit paid on card). By providing the handover code or paying the remaining balance, the customer acknowledges that they have inspected the vehicle, found it to be in acceptable condition, and are satisfied with its state. After providing the handover code or paying the remaining balance, no refunds can be granted if the customer later claims that the vehicle did not meet their requirements or was in poor condition.
- The customer agrees to wear a helmet, appropriate clothing, and to obey all local traffic laws. Drinking and driving is strictly prohibited.
- The customer shall not make any modifications or repairs to the vehicle without prior written consent from the supplier.
- The customer agrees to be liable for any loss, damages, traffic violations, fines, or penalties incurred during the rental period due to accident, theft, or any other causes arising from the customer's negligence, lack of skill, or lack of foresight.
- The customer further agrees not to lend the vehicle to any other persons during the rental period.
3. Supplier Responsibilities:
- The supplier is responsible for verifying that the customer possesses a valid driver's license and is legally allowed to operate the vehicle being rented.
- The supplier shall provide a vehicle in proper working condition and maintain it throughout the rental period.
- If the supplier is unable to provide the same vehicle the customer booked, such as in the case of double bookings or vehicle malfunctions, they are required to provide an alternative vehicle of equal or higher quality at no additional cost to the customer.
- The supplier may not change the price of the booking after it has been accepted. After the booking has been accepted this price is fixed until the end of the rental period. This applies to short-term bookings and monthly subscriptions where the customer is charged every month.
- If the payment is completely done by card through the app, the supplier must obtain the 2-digit handover code from the customer upon delivering the vehicle. If the supplier fails to input the handover code into the Flexbike app within 7 days of the rental period start date, they will not receive their payout.
4. Liability:
- The customer shall be liable for the amount equivalent to the repair costs or the market value of the vehicle, in case of loss or damage.
- The customer is responsible for obtaining their own insurance coverage if desired.
5. Dispute Resolution:
- Any disputes regarding damages to the vehicle should be addressed directly between the customer and vehicle supplier.
- In the event of a dispute, the customer must report damages and obtain repair estimates within 24 hours of the rental period's conclusion.
- If a dispute cannot be resolved amicably, both parties agree to participate in mediation or arbitration proceedings.
6. Limitation of Liability:
- Flexbike, Inc. ("Flexbike"), acting as the intermediary platform, along with its founders, staff, and affiliates, shall not be responsible or liable for any injury, death, or harm to the rider, passenger, or third party arising from the use of our services.
- Flexbike does not assume responsibility for any damages sustained to the vehicle during the rental period.
7. Age Restriction:
- Customers must be at least 18 years old to rent a vehicle through the Flexbike platform.
8. Privacy and Data Protection:
- Flexbike collects, uses, and protects customer personal information in accordance with applicable data protection laws.
- By using the Flexbike platform, customers consent to the collection and processing of their personal data as outlined in our Privacy Policy.
9. Commission:
- Flexbike charges a commission on each rental transaction facilitated through the platform. The commission is a percentage of the total rental amount and is deducted from the payment made by the customer before the remaining balance is released to the supplier.
- The commission rate is subject to change at Flexbike's discretion. Any changes to the commission structure will be communicated to suppliers in advance.
- Suppliers are responsible for taking the commission into account when setting their rental prices.
10. Circumvention of Platform:
- Suppliers and customers are prohibited from engaging in any transactions or communications that attempt to bypass the Flexbike platform, including but not limited to arranging for direct cash payments or providing contact information for the purpose of conducting transactions outside of the platform.
- Any attempts to circumvent the platform and avoid paying the commission will be considered a violation of these terms and conditions.
- Flexbike reserves the right to terminate the accounts of suppliers or customers who engage in such activities and pursue legal action if necessary.
11. Contract Supremacy:
- These Terms and Conditions shall take precedence over any other rental agreements, contracts, or documents that may be presented to the customer by the supplier. In the event of any conflict or inconsistency between these Terms and Conditions and any other agreements, the provisions of these Terms and Conditions shall prevail.
By booking a vehicle through the Flexbike platform or renting a vehicle out to customers as a supplier, the user acknowledges that they have read, understood, and agreed to be bound by these terms and conditions.
